IPWHO – TERMS OF SERVICE (v2.2)

These Terms form a binding agreement between you and Horizon Corporation Pty Ltd ATF Horizon Corporation Trust (ABN 73 177 208 691), trading as IPWho.

INTRODUCTION

These Terms govern your use of IPWho’s APIs (“Service”). By using the Service, you agree to them.

1. DEFINITIONS

  • “Customer” means the entity or individual using the Service.
  • “API Data” means the information returned by the API.
  • “Service” means IPWho’s APIs, dashboard, and related tooling.

2. ACCOUNT & SECURITY

You must keep your API keys private and secure. Do not embed keys in client-side code.

3. USE OF THE SERVICE

You must not:

  • Circumvent rate limits
  • Resell or redistribute API Data
  • Use the Service unlawfully
  • Disrupt, probe, or overload the platform
  • Use the Service to build a competing product

4. PLANS & BILLING

Pricing is listed at https://www.ipwho.org/pricing. Subscriptions renew automatically. Upgrades apply immediately; downgrades at the next billing cycle. Refunds are provided only where required by law.

5. SERVICE MODIFICATIONS

We may modify the Service at any time. If a change materially affects functionality, we will provide notice by email, dashboard message, or a notice on our website.

6. HIGH-RISK USE

The Service is not designed for high-risk or safety-critical environments.

7. PRIVACY & DATA PROCESSING

See our Privacy Policy and Data Processing Addendum.

8. SLA & SUPPORT

Standard support is available during business hours. Enterprise customers receive 24/7 Severity 1 support under the SLA.

9. INTELLECTUAL PROPERTY

We own the Service and related IP. You retain ownership of your software.

10. TERMINATION

You may cancel at any time via the dashboard. We may suspend accounts violating these terms.

11. LIMITATION OF LIABILITY

We are not liable for indirect or consequential loss. Our maximum liability is fees paid in the previous 12 months (AUD $100 for free plans).

12. EXPORT COMPLIANCE

Customer represents they are not subject to sanctions or restrictions.

13. GOVERNING LAW

Victoria, Australia.
